I hereby consent to the Nipper participating in part or all of the Nippers Program for the forthcoming summer season (Program) conducted at Balmoral Beach by BBC Events.

I have read and accept the conditions set out in the Notice to Nippers (which appears below) and I accept that the Nippers participation in the Program involves a range of risks (not limited to the risks specifically identified), including the risk of personal injury to the Nipper and that the Program could not occur unless all parents/guardians of all participating Nippers are willing to accept full responsibility for the consequences of these risks. Therefore, and in consideration of BBC Events accepting the Nipper as a participant in the Program, for myself, my heirs, executors and administrators, I hereby:

  • Acknowledge that the Nipper participates in the Program with my full consent and at his/her and my own risk;
  • Acknowledge that I am solely responsible for the Nipper at all times and that I do not rely on BBC Events or its directors, officers, agents, lifeguards and volunteers (collectively, the BBC Crew) or any of them to look after or take responsibility for the Nipper during the Program or any part thereof;
  • Acknowledge that I am the parent or legal guardian of the children that I have registered, and that my enrolment will be revoked immediately (without reimbursement of fees paid) should this not be the case;
  • Waive, release and discharge BBC Events, the BBC Crew, the Program sponsors and all other participating Nippers and each of them and their respective heirs, executors and administrators (collectively, the Releasees) from all claims and demands (save for any liability arising out of statutory guarantees, if any, pursuant to the Australian Consumer Law) whatsoever by the Nipper, myself or anyone else, including any claim for loss, damages or compensation caused or contributed to by the negligence of any one or more of them in the organisation or conduct of the Program, or any part thereof (including failure to warn of a particular risk), including any claim for reimbursement of any costs or expenses (not limited to legal, medical, hospital and rehabilitation expenses) that may be incurred by me or anybody on my and/or the Nipper’s behalf (collectively, Claims);
  • Agree to indemnify and hold harmless the Releasees and each of them against all Claims (save for any liability arising out of statutory guarantees, if any, pursuant to the Australian Consumer Law) that I, the Nipper or anybody on my and/or the Nipper’s behalf may have or make against the Releasees or any of them;
    Accept responsibility for my and the Nipper’s personal belongings during the course of the Program;
  • Waive, release and discharge BBC Events, the BBC Crew, the Program sponsors and all other participating Nippers and each of them and their respective heirs, executors and administrators collectively, the Releasees) from all claims and demands arising out of statutory guarantees, if any, pursuant to the Australian Consumer Law by the Nipper, myself or anyone else, to the extent the claim is for loss, damages or compensation for personal injury of death caused or contributed to by the negligence of any one or more of them in the organisation or conduct of the Program, (the ACL Claims);
  • Agree to indemnify and hold harmless the Releasees and each of them against the ACL Claims that I, the Nipper or anybody on my and/or the Nipper's behalf may have or make against the Releasees or any of them.
  • Agree that BBC Events may publish or use any photographs of the Nipper and/or myself taken at the Program in any of BBC Events’ publications, promotions or records, on its website or in such other manner as BBC Events may decide, without my prior approval or prior consultation with me;
  • Agree to follow code of conduct and encourage our child(ren) to do likewise;
  • Acknowledge that this Waiver shall remain in force for the duration of the Program and cannot be revoked by me.

Notice to Nippers – Participate at your own risk

  1. Participation in the Nippers Program (Program) conducted by BBC Events at Balmoral Beach is at each Nipper’s own risk. Whilst BBC Events organises and conducts the program to an appropriate standard of safety, it does not take responsibility for the care, safety or health of each Nipper during the Program - this always remains the responsibility of the Parent/Guardian of the Nipper, who should be in attendance during the Program to supervise his/her child. BBC Events does not provide a “Child minding” facility.
  2. The Parent/Guardian of any Nipper suffering from any medical condition should consult his/her medical advisor and follow such advice whether or not to allow the Nipper to participate in the Program or any aspect thereof.
  3. Parents/Guardians who are not proficient swimmers and/or unable to operate paddle boards should advise their relevant Age Manager and must ensure that they do not undertake any of these activities at any stage throughout the Program. Age group managers must also be advised of any Nippers who are not proficient swimmers prior to them undertaking any water-based activities and the parents/guardians or designated supervisors of those children must ensure that they are closely supervised during those activities at all times.
  4. A lifeguard, rescue equipment, medical or first aid attendant or other emergency assistance may not be present, or readily available, to assist each Nipper in case of an emergency.
  5. Participation in the Program has obvious risks and particular risks of harm, including, but not limited to:
    - Drowning;
    - Shark attack, or injury from other dangerous marine life;
    - Stings from sting-rays, jellyfish, jimbles, blue-bottles etc;
    - Sickness/infection resulting from polluted or contaminated sea water;
    - Injury/loss of life resulting from dangerous sea water conditions;
    - Injury from collision with other Nippers, BBC Crew, surf-skis, paddles, boards, or other objects in the water;
    - Suffering from cramp, epileptic fit, heart attack etc whilst participating;
    - Lightning might strike a Nipper whilst participating in the Program;
    - Submerged rocks and other hidden objects can cause injury;
    - Bare feet can be injured whilst running on the sand;
    - a Nipper may get lost or separated and suffer distress;
    - a parent/guardian may suffer mental distress in the event of an injury to his/her child.
  6. Every Nipper must exercise care and courtesy to avoid accidents, collisions with or injury to other participating Nippers.
  7. The program is intended to be good fun for all participating Nippers, to be an introduction to water and beach sports and to promote well-being, fitness and friendship. Each Nipper should enjoy himself/herself, but not to the detriment of any of the other Nippers.
